Here you will find the General Terms and Conditions of the DillySocks Online Shop.

1. Applicability of the GTC

DillySocks AG provides all deliveries and services based on the following GTC and the provisions listed herein.

These GTC apply for an indefinite period unless they have been amended by the parties in a written agreement. In all other respects, the provisions of the Swiss Code of Obligations (OR) concerning purchase agreements as well as other Swiss laws and ordinances shall apply.

Should a provision of these GTC be ineffective or contain a loophole, the legal validity of the other provisions shall remain unaffected. Instead of the ineffective provisions, an effective provision shall be deemed to have been agreed upon from the outset that comes closest to what the parties intended economically.

2. Offer and Conclusion of Contract

All offers from DillySocks AG are non-binding and merely represent an invitation to the customer to submit a binding offer for the conclusion of a purchase contract for the goods presented in the online shop. The contract is concluded upon acceptance of the order. The scope and execution of the delivery are determined by the confirmation from DillySocks AG. In cases of obvious typing and calculation errors, DillySocks AG is entitled to withdraw from the contract.

3. Prices and Shipping Costs

The prices stated in the online shop are non-binding and can be adjusted by DillySocks AG at any time. All prices include the statutory value-added tax. Shipping and packaging costs are listed separately under "Shipping" in the footer. For deliveries outside Switzerland, the customer shall bear any applicable taxes and customs duties.

4. Payment

DillySocks AG accepts the following payment methods:

Klarna (Installment payment / Invoice purchase)

CembraPay

Delivery will take place after successful payment. DillySocks AG reserves the right not to offer individual payment methods without stating reasons. Payment data is processed exclusively by the respective payment service provider; DillySocks AG does not receive any credit card or bank details.

Note: By using external payment service providers, their respective terms of use and data protection policies apply in addition to these GTC.

5. Delivery and Delivery Times

Deliveries are made to the delivery address specified by the customer in the order. Current shipping partners are Swiss Post (Switzerland), DHL / Deutsche Post, and DPD (EU and international). DillySocks AG is not liable for shipping delays. The risk transfers to the customer upon dispatch of the goods.

6. Warranty and Return Policy

If defects in delivered goods are proven by the customer, the customer has the right, at their discretion, to a replacement delivery or cancellation of the purchase. If the goods cannot be redelivered, the cancellation of the purchase comes into effect.

Excluded from the warranty are defects and malfunctions for which DillySocks AG is not responsible, such as natural wear and tear, force majeure, improper handling, interventions by the customer or third parties, excessive strain, or extreme environmental influences.

The delivered goods will be taken back by DillySocks AG within 30 days of receipt, provided the goods are unused and the packaging and labels are undamaged. The shipping costs for the return shall be borne by the customer. Upon receipt of the goods by DillySocks AG, the goods will be exchanged or the purchase price refunded at the customer's request. The shipping costs incurred at the time of order will not be refunded.

DillySocks AG reserves the right to refuse returns if the returned goods are not in the condition mentioned above.

If the customer resells the products, they are responsible for complying with domestic and foreign export regulations. If the customer modifies the resold products, they are liable for any resulting damages to DillySocks AG, the buyer, or third parties. The provisions of product liability law remain reserved.

7. Newsletter and Customer Account

DillySocks AG offers a newsletter and the option to create a customer account. Newsletter registration is voluntary via a double opt-in process. The newsletter can be unsubscribed from at any time using the unsubscribe link.

DillySocks AG uses the service Klaviyo (Klaviyo, Inc., USA) for sending and analyzing the newsletter. The customer account enables an order overview and a faster checkout process.

8. Data Protection

Customer data is treated confidentially in accordance with the Swiss Federal Data Protection Act (DSG) and – where applicable – the EU General Data Protection Regulation (GDPR).

Detailed information on data processing (collected data, purposes, recipients, rights of data subjects) can be found in DillySocks AG's data protection policy at www.dillysocks.live/pages/datenschutz. The data protection policy is an integral part of these GTC.

9. Final Provisions

The place of jurisdiction is the registered office of DillySocks AG. However, DillySocks AG may also call upon the court at the customer's domicile. Exclusively Swiss law shall apply, even if ordered from abroad or delivered abroad.

The parties shall endeavor to resolve any disputes arising from the implementation of this contract amicably.

By ordering goods, these general terms and conditions are deemed accepted by the customer. Changes or additions to the general terms and conditions shall be made exclusively by DillySocks AG and must be in writing.
